Dispute Resolution

Investigations, advice and solutions to resolve construction problems and defects including expert witness and mediation services.

A dedicated ‘problem solving' unit specialising in providing practical solutions and facilitating the resolution of defects and the settlement of disputes with minimum risk, cost and disruption to the client's business.

Problems and defects have included partial structural collapse of accidental or fire damaged buildings; ground movement, subsidence/heave, retaining walls etc.; water ingress; drainage problems; ground contamination; health and safety matters under the CDM Regulations and structural aspects under the Party Wall etc. Act.

Resolution of disputes has included responsibility for defects, cost, programme and technical matters.

Investigations and Repairs of Defects

  •  Investigation and evaluation to ascertain the cause and consequence of the defects
  • Determination and design of practical remedial measures commensurate with the client's needs
  • Implementation of remedial works
  • Assessment of the impact of the remedial measures in terms of costs, time and disruption
  • Undertake discussions and negotiations with the parties to try and agree responsibilities and appropriate contributions

Dispute Resolution

Where possible we endeavour to achieve settlement of disputes through constructive dialogue, negotiation and/or mediation where appropriate supported by sound remedial works design. Where negotiation or other forms of dispute resolution are unsuccessful we are able to provide expert witness services in support of arbitration or litigation.

Negotiation and Constructive Dialogue

Many problems and disputes can be resolved by negotiation or constructive dialogue. This process is facilitated by an independent party analysing the problem, identifying the key issues and leading a process of constructive dialogue. This problem solving route avoids the more expensive formal dispute resolution processes.

Arbitration and Mediation

Mediation services are carried out by a qualified Mediator with a view to developing a solution that is acceptable to all parties.

Expert Witness

Expert Witness services in support of litigation or arbitration are provided for construction related technical matters.
